Trademarks, Copyrights, and Internet Law

KHMRG has an active trademark, copyright, and Internet law practice. The Firm has filed thousands of trademark and copyright applications on behalf of its clients. The Firm also regularly secures domain names through registration and through ICANN arbitration proceedings, and maintains an active anti-piracy program on behalf of numerous clients. In addition to procuring trademarks and copyrights, the Firm counsels clients on protecting these investments, including with respect to unauthorized use by third parties. The Firm also renders opinions on trademark infringement and validity.

Litigation

KHMRG represents clients in a variety of adversarial proceedings relating to patents, trademarks, trade secrets, copyright, and domain name disputes. These cases have involved many different fields and diverse technology, such as automotive products, music rights, publishing rights, computer hardware, telecommunications, exercise equipment, medical devices, consumer items, and optics. In addition to matters in federal and state court, KHMRG has handled patent post-grant proceedings and trademark cancellation and opposition proceedings for clients before the United States Patent and Trademark Office, as well as domain name arbitration proceedings before the Arbitration Forum.

Transactional

KHMRG structures, drafts, and negotiates many different types of intellectual property transactions. For example, the firm regularly works on intellectual property licenses, technology transfer agreements, marketing and distribution arrangements, software licenses, advertising and entertainment arrangements, work for hire agreements, non-compete agreements, and personality rights. The firm also has substantial experience with e-commerce and Internet-related transactions, including agreements for website development and hosting, co-branding, Internet-based services, and content licensing.
